These Terms of Service (“Terms”) are a legal agreement between you and the owner and operator of Techdamentals (“Techdamentals,” “we,” “us,” “our”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
The Service applies standard valuation models (such as discounted cash flow) to third-party financial data and produces the same impersonal output for every user. It does not consider your personal financial situation, objectives, or risk tolerance.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose. Data is sourced from third parties and may be delayed, inaccurate, or incomplete, and model assumptions may not hold. Outputs can be materially wrong. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
Investing involves risk, including the possible loss of principal. You are solely responsible for your own investment decisions and for any gains or losses resulting from them. Past or hypothetical performance does not guarantee future results.
To the maximum extent permitted by law, we and our owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, investment losses, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve (12) months before the claim, or US$50.
You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
The Service relies on data and services provided by third parties. We do not own, control, or guarantee that data, and it may change or become unavailable without notice. We are not responsible for third-party content or services.
You must be at least 18 years old and legally able to enter into these Terms. The Service is not directed to persons in jurisdictions where its use would be contrary to law, and it is your responsibility to comply with local laws.
Paid features, if any, are billed through our third-party payment processor. Prices, plans, and features may change. Except where required by law, fees are non-refundable. You may cancel a subscription at any time; access continues through the end of the paid period.
We may modify or discontinue the Service, and may update these Terms, at any time. Continued use after changes take effect constitutes acceptance of the updated Terms.
These terms apply to anyone accepted into the Techdamentals partner program described at techdamentals.com/partners. Applying is agreement to them; the welcome email a partner receives restates them. If this section and the program page ever differ, this section governs.
Acceptance. Partners are accepted by Techdamentals at its discretion after reviewing an application. Acceptance creates an independent, non-exclusive relationship. A partner is not an employee, agent or representative of Techdamentals and may not make commitments on its behalf.
The link and credit. Each partner receives a referral link. A visitor who arrives through it and creates an account within 30 days is credited to that partner, once, at signup; where more than one partner link reached the same visitor, the first is credited. Credit is recorded automatically and is not transferable or applied after the fact.
Commission. A partner earns 30% of the subscription fees Techdamentals actually collects from each credited customer, for as long as that customer keeps paying and the partnership continues, unless different terms were agreed with that partner in writing. Each payment counts toward the balance 30 days after it is made, once the refund period has passed. Refunds and chargebacks reduce the amount earned, which can bring a balance below zero and carry forward. No commission is earned on payments by Techdamentals' own accounts, by a partner's own account, or on any amount Techdamentals does not receive.
Payment. Balances of $25 or more are paid monthly by PayPal or bank transfer. A partner is responsible for any taxes on amounts received and for supplying any tax form Techdamentals reasonably requires before payment.
Conduct. A partner must disclose the referral relationship wherever the link appears; must not present Techdamentals as investment advice, as a recommendation to buy or sell any security, or as a service that selects investments for its users; must not make false statements about the Service; and must use the link only with their own audience, not through paid advertising on the Techdamentals name, coupon or deal sites, or incentives to sign up.
Ending the partnership. Either side may end the partnership at any time by notice. Techdamentals may end it immediately for a breach of the conduct terms or for false statements about the Service. From the date the partnership ends, payments by credited customers earn no further commission; commission earned before that date remains payable under the payment terms. Honest criticism of the Service is not a breach.
Changes. Techdamentals may change the program's terms for future referrals on 30 days' notice to partners. Customers credited before a change remain on the terms in force when they were credited.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
